Terms of service

These Terms of Service ("Terms") govern your use of lushbow.com and any purchase you make from it (the "Services"). By using the Services you agree to these Terms. Please read them together with our Privacy Policy, Refund Policy and Shipping Policy.

1. Who you're buying from

The seller in every sale is Emona Marketing, LLC, a Delaware limited liability company trading as Lushbow, 8 The Green, Ste D, Dover, Delaware 19901, United States. You can reach us at service@lushbow.com.

2. Using the Services

You must be at least 18 years old, or the age of majority where you live, to make a purchase. The Services are not directed at children. You're responsible for keeping your account credentials secure and for anyone who uses your account or device. Accounts can't be transferred.

3. Products and appearance

We make every effort to display our products accurately, but colours and finishes may look different on different screens. We may change product details, availability or pricing at any time, discontinue products, or limit quantities per order.

4. Product information and safe use

Our skincare, shaving and recovery products are cosmetics and general consumer goods. They are not medical treatments and nothing on the Services is medical advice. Patch-test new products on a small area of skin and stop using them if irritation occurs; avoid contact with eyes; keep out of reach of children.

Dietary supplements. Cortisol Calm and any other supplement we sell is a dietary supplement. Statements about supplements on the Services have not been evaluated by the Food and Drug Administration, and these products are not intended to diagnose, treat, cure or prevent any disease. Do not exceed the recommended dose. If you are pregnant, nursing, taking medication or have a medical condition, consult a healthcare professional before use.

Sunscreen. Daily Defense Moisturizer SPF 30 is an over-the-counter sunscreen drug product; use as directed on the label and reapply as instructed.

Razors and blades. Double-edge blades are extremely sharp. Handle by the edges, keep away from children, and dispose of used blades safely in a blade bank or sealed container.

Candles. Never leave a burning candle unattended. Keep away from drafts, flammable materials, children and pets. Trim the wick before each use and stop burning when 1/2 inch of wax remains.

Full ingredient lists are printed on each product and available on request by email.

5. Orders

Your order is an offer to buy. We accept it when we confirm acceptance or dispatch; until then we may decline it for reasons including stock availability, pricing or description errors, suspected fraud, or indications of resale. We ship within the United States only, and products are sold for personal use.

6. Prices, taxes and payment

Prices are in US dollars and may change, but the price confirmed when you place an order is the price you pay. Shipping and applicable taxes are added at checkout unless stated otherwise. Promotions may carry their own terms. Payments are processed by Shopify Payments and other payment providers; by paying, you confirm you're authorised to use the payment method.

7. Shipping and risk of loss

Delivery dates are estimates. We're not liable for carrier delays, but risk of loss stays with us until the parcel is delivered to the address you provided. Lost parcels are handled through a carrier claim and a replacement or refund, as set out in our Shipping Policy.

8. Returns, refunds and cancellations

These are governed by our Refund Policy, which forms part of these Terms and controls if there is any conflict.

9. Reviews and feedback

If you submit reviews, photos, suggestions or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with the Services. Reviews must be truthful and based on your own experience, and any incentive you received must be disclosed. We publish reviews regardless of rating and don't suppress negative reviews, but we may remove content that is unlawful, abusive, off-topic or in breach of these Terms.

10. Intellectual property

The Services and their content, including text, images, logos and the Lushbow name and marks, are owned by us or our licensors. You may use them for personal, non-commercial purposes only. Copying, redistributing or creating derivative works requires our written permission.

11. Prohibited uses

You must not use the Services to break the law, infringe anyone's rights, harass others, spread malware, post false or misleading information, impersonate anyone, scrape or harvest personal data, send unsolicited messages, or bypass security or access controls. We may suspend or close accounts that breach these Terms.

12. Automated access and AI agents

Automated agents may browse or purchase on a user's behalf provided they identify themselves as agents in their user-agent string, don't impersonate humans or circumvent CAPTCHAs or rate limits, and disclose that they are automated when asked. We may restrict automated access at any time. Scraping content for redistribution or for training machine-learning models requires our written permission.

13. Third-party links and tools

The Services may include links to, or tools from, third parties we don't control. We provide them "as is" and aren't responsible for them. Complaints about third-party sites should be directed to the third party.

14. Shopify

Our store runs on Shopify, which is not a party to any sale between you and us. To the extent permitted by law, you release Shopify from claims relating to products you purchase from us.

15. Privacy

Our handling of personal information is described in our Privacy Policy. Shopify also processes some data under its own policy, and data may be transferred internationally.

16. Errors and corrections

We may correct errors, inaccuracies or omissions, including in pricing and availability, at any time. If an error affects an order you've placed, we may cancel the affected order and issue a full refund.

17. Availability, suspension and termination

We may modify or discontinue the Services, and may terminate your access for material breach of these Terms. Orders we've accepted and you've paid for will still be fulfilled or refunded. Sections that by their nature should survive (including 9, 10 and 18 to 23) survive termination.

18. Disclaimers

Information on the Services is general and may not be complete or current. To the fullest extent permitted by law, the Services are provided without implied warranties, including of merchantability or fitness for a particular purpose. Product warranties required by consumer protection law still apply.

19. Limitation of liability

To the extent permitted by law, we and our officers, employees, affiliates and suppliers aren't liable for indirect, incidental, special or consequential damages arising from the Services or products. Where liability can't be excluded, it's limited to the amount you paid for the products giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for defective products, or for anything else that can't be excluded by law.

20. Indemnity

You agree to cover our reasonable losses, costs and legal fees arising from third-party claims caused by your breach of these Terms, your unlawful use of the Services, or your infringement of someone's rights. This doesn't apply to ordinary use of the Services or to ordinary disputes about an order. We'll notify you of any such claim and won't settle it in a way that binds you without your consent.

21. Statutory rights

Nothing in these Terms removes or limits rights you have under applicable consumer protection law.

22. Resolving disputes

If you have a problem, email us first at service@lushbow.com; most issues are resolved quickly. If we can't resolve it within 30 days, either of us may take the matter further. These Terms don't require arbitration and don't waive your right to participate in a class action. You may bring eligible claims in small claims court.

23. Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Claims may be brought in the state or federal courts located in Delaware, except that if you're a consumer you may bring claims in the courts where you live where local law allows, and you keep the protection of your home state's consumer laws.

24. Events beyond our control

We're not liable for delays or failures caused by events outside our reasonable control, such as carrier failures, severe weather, strikes, outages or government action. We'll let you know and, if we can't fulfil your order within a reasonable time, offer a refund.

25. Changes to these Terms

We may update these Terms at any time by posting the revised version here. Changes apply going forward; the version in force when you placed an order governs that order. Continued use of the Services after changes means you accept them.

26. General

If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a right isn't a waiver of it. You may not assign these Terms; we may assign them to a successor. These Terms, together with the policies referenced above, are the entire agreement between you and us about the Services. We may give you notice by email.

27. Accessibility

If you experience any barrier using the Services, email us and we'll help, including placing an order for you by email.
